Terms and Conditions of Sale

Article 1: Seller Identification

The website https://uneviealacampagne.fr is operated by Mr Cyril PIERRI, a sole trader (entrepreneur individuel, EI), under the trading name “Une Vie à la Campagne”.

Une Vie à la Campagne is the owner and sole publisher of the website https://uneviealacampagne.fr, hosted on the o2switch platform and powered by the WordPress content management system.

The website is protected by French intellectual property law. Any reproduction of elements of the site is prohibited. It is also prohibited to extract or reuse the articles or product descriptions written by Une Vie à la Campagne.

Any natural or legal person who buys one or more products on the business’s website is referred to as a “customer”. Any natural or legal person who visits the site https://uneviealacampagne.fr is referred to as a “visitor”.

Customers and visitors are bound by these general terms and conditions of sale (the “Terms”) and agree to comply with them. Une Vie à la Campagne undertakes to make these Terms available before any order is confirmed.

Une Vie à la Campagne reserves the right to amend these Terms at any time. The version that applies is the one in force on the date of the order.

Article 2: Terms of Use of the Une Vie à la Campagne Website

By accepting the Terms, the customer certifies that they have reached the age of majority in their country or have the permission of their legal representative before placing an order.

The customer is the holder of their payment method or has the agreement of the holder of the payment method used to place an order.

The customer agrees not to use the site for any unlawful purpose.

Une Vie à la Campagne reserves the right to remove any customer review that is abusive or incites hatred, in order to ensure a constructive space for discussion.

Article 3: Products

Products are offered while stocks last.

Une Vie à la Campagne reserves the right to add, withdraw and change the items on sale without informing site users beforehand.

Une Vie à la Campagne also reserves the right to put items on sale that do not yet have a product description. Online product pages may be corrected, changed or removed.

It is the customer’s responsibility to contact the business at the following email address: contact@uneviealacampagne.fr to ask for information about the products before making a purchase.

Article 4: Prices, Delivery Costs and Payment

All prices of the products offered by Une Vie à la Campagne are final prices, all taxes included, unless otherwise stated. They are shown in the currency of the version of the shop the customer is using; prices in a currency other than the euro are converted from our euro prices using the European Central Bank reference exchange rate, then rounded.

Une Vie à la Campagne reserves the right to change its prices at any time of the year, without notice or justification. The price shown when the order is confirmed is the one that applies, and every order constitutes acceptance of that price.

A customer who bought a product at a higher price, following a price increase or the end of a temporary promotion, cannot rely on these variations to ask for a refund of the difference.

The business may offer discount codes to customers. It makes no commitment as to the period of validity of discount codes or the rate of discount offered.

Delivery is free for parcels sent to Canada. For deliveries outside the European Union, customs duties, taxes or clearance fees may be charged on receipt by the customs authority or the carrier of the destination country; unless otherwise stated when ordering, they are not included in the price and are payable by the recipient. For deliveries within the European Union, if the order is worth more than €150, VAT, any customs duties and carrier fees may be requested on delivery.

Une Vie à la Campagne reserves the right to refuse an order depending on the destination and the cost of delivery, and informs the customer by email.

The customer can pay by the following methods:

  • Payment by bank card through the secure Stripe platform;
  • Payment by PayPal, including PayPal’s pay-in-4 option where PayPal offers it in the customer’s country, subject to acceptance by PayPal;
  • Payment in 3 interest-free instalments by bank card through Klarna, where Klarna offers it in the customer’s country, subject to acceptance by Klarna.

By confirming the order, the customer authorises Une Vie à la Campagne to debit their bank account or PayPal account with the amount corresponding to the price of the order. Une Vie à la Campagne cannot be held responsible for a malfunction of the Stripe, PayPal or Klarna payment services.

In the event of non-payment or a payment incident, the customer is informed that the business may suspend or cancel the order. Delivery is conditional on full and correct receipt of payment.

Article 5: How to Order

Une Vie à la Campagne operates a sales model without its own stock: products are selected from partner suppliers located in Europe and outside Europe, and are shipped directly from their warehouses to the customer’s address. Une Vie à la Campagne remains the customer’s sole point of contact for any question about the order, delivery or after-sales service.

We offer a selection of equipment and accessories for country living: backyard poultry (chicken coops, incubators, fencing, drinkers and feeders), beekeeping, garden birds and wildlife, the self-sufficient vegetable garden and small self-sufficiency equipment.

We choose our partners carefully, making sure they share our commitment to quality and customer satisfaction.
This way of working allows us to offer a diverse range while keeping our prices competitive.

To ensure a smooth and efficient experience, our partners handle the shipping of products directly from their warehouses. They strive to provide reliable and secure deliveries.

We undertake to work only with suppliers that comply with the applicable European standards (CE marking where applicable) and high quality standards.

No account is needed to place an order. The customer goes to https://uneviealacampagne.fr, selects the product(s) of their choice and the quantity, and adds them to the basket.

Each item has its own description page. Photographs match the products as closely as possible, but some are given for illustration only and are not contractually binding.

By clicking the order button, which commits them to pay, the customer completes the order by entering their details. Orders are processed only after payment has been received and cleared.

Article 6: Order Confirmation and Invoice

When completing their order, the customer enters the personal details needed for their invoice and for delivery.

The customer chooses their payment method, reads these Terms carefully and accepts them by ticking the box provided for that purpose. This box is never ticked in advance.

Once the order has been confirmed and payment made, the customer receives by email:

  • An order confirmation email showing the order number, the items ordered and the total price;
  • An invoice issued automatically to the email address given at the time of purchase.

The delivery time starts from receipt of the confirmation email.

Article 7: Cancelling or Refusing an Order

As long as their order has not been shipped, the customer can cancel it by writing to contact@uneviealacampagne.fr with their order number.

Once the order has been shipped, it can no longer be cancelled in this way, but the customer keeps their 14-day right to cancel, which they can exercise from the moment the order is placed until 14 days after receiving it (see Article 9). If the consumer protection law of the country, province or state where the customer lives gives them additional cancellation rights, for example if the order is not delivered on time, those rights also apply.

If the order is cancelled or the right to cancel is exercised, Une Vie à la Campagne refunds all sums paid, including the initial delivery costs, no later than 14 days after the customer’s request.

Une Vie à la Campagne also reserves the right to refuse any order from a buyer for a legitimate reason, in accordance with Article L121-11 of the French Consumer Code.

This applies if the order is abnormal or placed in bad faith, if there is a dispute with the buyer concerning payment for a previous order, or for any other lawful reason.

Une Vie à la Campagne informs the buyer of its decision without being obliged to give reasons.

Article 8: Delivery

Une Vie à la Campagne shows the estimated delivery times for each product on its product page. The delivery time starts from receipt of the order confirmation email.

Delivery times vary according to the product, the quantity ordered and the country from which the supplier ships. As a guide:

  • Products shipped from Europe: between 3 and 7 working days;
  • Products shipped from Asia: between 10 and 30 working days, depending on customs and logistics conditions.

For personalised products, the production time shown on the product page is added to these times (see Article 9 bis).

These times may vary depending on product availability, transport conditions or possible customs checks. The delivery time that applies is the one shown on the product page; if none is shown, the order is delivered no later than 30 days after the contract is concluded (Article L216-1 of the French Consumer Code). Une Vie à la Campagne remains responsible for the proper delivery of the order, including when it is entrusted to a carrier (Article L221-15 of the French Consumer Code).

The customer agrees to provide a precise and complete delivery address. Otherwise, Une Vie à la Campagne cannot be held responsible for a delivery problem.

If the order includes several items, they may be delivered on different dates.

When ordering, the customer can choose between home delivery and delivery to a pick-up point, depending on the options available for the product. If the chosen pick-up point is unavailable, Une Vie à la Campagne will redirect the parcel to the nearest alternative pick-up point. The customer will be informed by email and should check the details of the new pick-up point before going there. The parcel must be collected within the time allowed; otherwise it will be returned to the sender.

If delivery is late, the order is not cancelled. Une Vie à la Campagne informs the buyer by email. In accordance with Article L216-2 of the French Consumer Code, the buyer may formally require Une Vie à la Campagne to make the delivery within a reasonable additional period, by email to: contact@uneviealacampagne.fr.

If non-delivery is confirmed, Une Vie à la Campagne carries out a check before any refund or reshipment. Une Vie à la Campagne is not liable if non-delivery results from an incorrect address provided by the customer, from force majeure or from an unforeseeable event.

If a parcel arrives visibly damaged, the customer is invited to refuse delivery and note the reasons on the delivery slip. If it cannot be checked on delivery, we invite the customer to report any visible defect to us as soon as possible, ideally within 10 days, by email to contact@uneviealacampagne.fr, with photos. This recommended period in no way reduces the legal guarantee of conformity (at least 2 years from delivery, Article 11) or the guarantee against hidden defects (Article 12).

Article 9: Returning a Product under the Right to Cancel

Under Directive 2011/83/EU on consumer rights and Article L221-18 of the French Consumer Code, the consumer customer has 14 calendar days from the day after receiving the goods to cancel, without having to give any reason. If the period ends on a Saturday, Sunday or public holiday, it is extended to the next working day.

If the order includes several goods delivered separately, the period runs from receipt of the last item.

How to exercise your right to cancel:

  • Online (recommended): using the dedicated form available here to exercise your right to cancel: fill in the form, click “cancel contract here”, then “confirm cancellation”. An acknowledgement of receipt will be sent to you immediately by email, in accordance with Article L221-21 of the French Consumer Code.
  • By email: by sending the model cancellation form (downloadable here) to contact@uneviealacampagne.fr, with the subject line “Cancellation — [Your name]”.

Simply sending the product back without a prior statement, or refusing delivery, does not constitute a valid cancellation.

Returning the product:

Once the cancellation has been notified, Une Vie à la Campagne gives the customer, within 24 hours, the return address to use. This address is in France or in the customer’s country, depending on the product; the customer cannot be required to return the product directly to the supplier.

The customer has 14 days from sending their cancellation statement to return the product. Return costs are borne by the customer, unless Une Vie à la Campagne failed to inform them of this beforehand, in which case these costs are borne by Une Vie à la Campagne. The product must be returned complete (accessories, instructions), if possible in its original packaging.

Refund:

Une Vie à la Campagne makes the refund within 14 days of receiving the cancellation statement. However, Une Vie à la Campagne may withhold the refund until it has actually received the returned product or until proof of its dispatch has been provided.

The refund is made using the same payment method as the one used for the purchase, at no extra cost. In case of delay, the increases provided for in Article L242-4 of the French Consumer Code apply.

Exceptions to the right to cancel:

Under Article L221-28 of the French Consumer Code (Article 16 of Directive 2011/83/EU), the right to cancel does not apply to:

  • Products made to the customer’s specifications or clearly personalised;
  • Products liable to deteriorate rapidly;
  • Products unsealed by the customer after delivery that cannot be returned for hygiene reasons;
  • Products that cannot be separated from other items after being opened.

In accordance with Article L221-5 of the French Consumer Code, a model cancellation form is available to you. You can download it here.

The refund covers all sums paid, including the initial delivery costs (up to the cost of the least expensive standard delivery method we offer). If the returned product has been damaged or handled beyond what is necessary to establish its nature, characteristics and proper functioning, Une Vie à la Campagne may deduct the resulting loss of value from the refund (Article L221-23 of the French Consumer Code), and will explain this to the customer by email.

Article 9 bis: Personalised Products

Some items are made to order using information provided by the customer: first name, text, date, photo or design. These personalised products are identified as such on their product page and are subject to the following rules.

No right to cancel. Under Article L221-28, 3° of the French Consumer Code (Article 16(c) of Directive 2011/83/EU), the right to cancel does not apply to goods made to the customer’s specifications or clearly personalised. A personalised product that matches the order therefore cannot be taken back, exchanged or refunded simply because the customer has changed their mind.

Checking the information. Before confirming their order, the customer checks the spelling, dates, characters (including accents, special characters and, where applicable, non-Latin characters), the colours chosen and the quality of the photos sent. The product is made exactly according to the information approved: an input error by the customer is not a defect in the product. If there is any doubt about a request, Une Vie à la Campagne contacts the customer before production.

Content we refuse. The customer guarantees that they hold the rights to the texts, photos and designs they send. Une Vie à la Campagne refuses any request reproducing a protected trademark, logo, character or work, or the image of a person without their consent, as well as any abusive, discriminatory or unlawful content. If a request is refused, the order is cancelled and refunded in full.

Production time. Personalisation requires a production time, shown on the product page, which is added to the delivery time provided for in Article 8.

Appearance. Colours, engravings, embroidery and prints may differ slightly from the preview shown on screen; this is not a defect.

Guarantees still apply. Personalised products remain covered by the legal guarantee of conformity (Article 11) and the guarantee against hidden defects (Article 12). An item that is faulty, damaged on delivery or different from the information approved by the customer will be replaced or refunded.

Article 10: Gift Cards

No gift cards are currently offered for sale on the site.

Article 11: Legal Guarantee of Conformity

In accordance with Articles L217-3 to L217-20 of the French Consumer Code, every consumer benefits from a legal guarantee of conformity.

The legal guarantee of conformity protects the customer against all manufacturing defects in the product for 2 years from delivery of the goods.

It allows the customer to obtain repair or replacement of the non-conforming goods and, failing that, a price reduction or a refund.

The scope of the legal guarantee of conformity covers defects arising from the goods themselves or from the packaging.

The legal guarantee of conformity applies to contracts for the sale of new physical goods.

If the customer notices a defect less than 2 years after delivery, they contact Une Vie à la Campagne’s support team, explaining the lack of conformity and enclosing proof of purchase, such as an invoice.

Une Vie à la Campagne invites the customer to attach photos or videos of the non-conforming product to their request, to demonstrate and prove the lack of conformity.

In the event of a lack of conformity, the customer chooses between repair and replacement of the goods. We may not follow this choice if the solution requested is impossible or disproportionately costly compared with the other; we then offer the other solution or, failing that, a refund of the product against its return, or a price reduction if the customer prefers to keep it. Shipping costs related to bringing the product into conformity are borne by us.

The refund or replacement will take effect if, and only if, the defect found in the product is, in law, a lack of conformity.

A defect resulting from a substantial modification by the customer is not a lack of conformity.

In addition, the legal guarantee does not apply if the customer was aware of the defect or of the disputed characteristic at the time of purchase, or could not have been unaware of that defect at the time of purchase.

Information on the legal guarantees

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.

Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned period of supply. During this period, the consumer only needs to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.

The legal guarantee of conformity requires the trader, where applicable, to provide all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer asks for the goods to be repaired but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.

The consumer may obtain a reduction in the purchase price by keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:

  • 1° The trader refuses to repair or replace the goods;
  • 2° The goods are repaired or replaced after a period of thirty days;
  • 3° The repair or replacement of the goods causes significant inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
  • 4° The goods remain non-conforming despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to ask for the goods to be repaired or replaced first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods. These rules apply without prejudice to any more favourable mandatory rules of the country where the consumer lives: nothing in these Terms excludes or limits the guarantees that the consumer law of their country, province or state does not allow us to exclude or limit, and the 14-day period in Article 9 concerns only the right to cancel, never the consumer’s rights in respect of a faulty product.

Article 12: Guarantee against Hidden Defects

Under Article 1641 of the French Civil Code, the seller is bound by a guarantee against hidden defects in the item sold that make it unfit for its intended use, or that reduce that use so much that the buyer would not have bought it, or would have paid a lower price for it, had they known about them.

The legal guarantee against hidden defects allows the customer to obtain a full or partial refund and compensation if the product causes damage.

The customer can also obtain a replacement of the goods.

The guarantee may apply provided that the following 3 cumulative conditions are met:

  • The defect in the product must be hidden (not visible at the time of purchase)
  • The defect makes the goods unusable or greatly reduces their use
  • The defect must have existed at the time of purchase.

The legal guarantee lasts 2 years from discovery of the defect.

If a hidden defect is discovered, the customer contacts Une Vie à la Campagne’s support team, explaining the situation and stating the type of refund and the compensation they would like.

Any request must be accompanied by proof of purchase.

It is for the customer to prove the existence of the hidden defect.

As a professional seller is presumed to know of the defects in the item sold, the customer may also claim compensation for the harm caused by the defect (Article 1645 of the French Civil Code).

Une Vie à la Campagne undertakes to act in good faith in the event of a hidden defect in a product or a lack of conformity, by explaining personally to any customer wishing to rely on a legal guarantee the procedure that applies.

Article 13: Personal Data and Cookies

Une Vie à la Campagne collects the personal data needed to carry out orders: surname, first name, delivery address, email address, telephone number, and payment data processed through Stripe, PayPal and Klarna. These data are processed in accordance with the EU General Data Protection Regulation 2016/679 (GDPR).

The processing is based on the performance of the sales contract and on the seller’s legal obligations. The data are not sold to third parties.

They may be passed to the service providers responsible for performing the contract: carriers, payment platforms (Stripe, PayPal, Klarna) and partner suppliers responsible for shipping.

Transfers of data outside the European Union: under the sales model without own stock, some data needed for shipping (name, delivery address) may be passed to suppliers located outside the European Union, in particular in Asia.

Under the GDPR, every customer has the right of access, rectification, portability, objection and erasure of their data, which they can exercise by writing to: contact@uneviealacampagne.fr. They can also lodge a complaint with a supervisory authority, in particular the one in the country where they live, or with the French CNIL.

Data are kept for the duration of the commercial relationship and then for 3 years from the last contact, unless the law requires otherwise. Accounting documents (invoices) are archived for the period required by law.

The site places cookies in users’ browsers so that it works properly. Each user is free to accept or refuse them using the consent banner. Disabling some cookies may make certain services unavailable.

Article 14: Force Majeure

All the business’s obligations under this sales contract will be suspended in the event of force majeure, in accordance with Article 1218 of the French Civil Code.

Une Vie à la Campagne undertakes to inform the buyer of any event of force majeure that may hinder or delay the proper performance of the contract.

Article 15: Severability

If any clause is found to be contrary to a provision of French law in force, it will be deemed not to have been written.

This will in no case render the other clauses, or these general terms and conditions of sale as a whole, entirely void.

Article 16: Customer Service and Complaints

In the event of a disagreement about an order, Une Vie à la Campagne and the customer undertake to resolve it amicably. The customer can contact the support team at contact@uneviealacampagne.fr. Une Vie à la Campagne undertakes to reply within 15 working days.

If no amicable solution is found, and in accordance with the provisions of the French Consumer Code on the mediation of consumer disputes, the customer may refer the matter free of charge, whatever the country they live in, to:

Article 17: Governing Law and Jurisdiction

These general terms and conditions of sale are governed by French law. This choice does not deprive a consumer customer who lives in another country of the European Union of the protection afforded to them by the mandatory provisions of the law of their country (Article 6 of Regulation (EC) No 593/2008, “Rome I”). If the customer lives outside the European Union, it likewise does not deprive them of the protection of the mandatory consumer protection rules of their country, province or state.

If a disagreement cannot be resolved amicably, all disputes relating to these Terms will be submitted to the competent court in accordance with the legal and regulatory provisions in force and the nature of the dispute.

Under Article 46 of the French Code of Civil Procedure, the claimant may bring proceedings, at their choice, before the court of the place where they live or the court of the place where the goods were actually delivered or the service was performed.

The Une Vie à la Campagne website is published in accordance with French law.

This statement does not reduce any of the consumer customer’s rights set out in these Terms.
